general

1 - REGISTRATION
 
Fit Travel's general registration conditions are accepted from the first payment, (including deposit) and regardless of the method of payment
(only bank transfers are accepted). Any communication of banking information and any acceptance of a document from Fit Travel also implies knowledge and acceptance of the general conditions of registration. In accordance with the article of the consumer code, people registered in a sports program do not benefit from the seven-day withdrawal period. For registrations occurring less than thirty (30) days before the date of departure, the full price is due to Fit travel. For registrations more than thirty (30) days before the date of departure, a deposit of 30% of the price of the stay is imperatively requested. The full price of the stay must be paid no later than sixty (60) days before departure. No registration will be recorded by Fit Travel without payment of the corresponding deposit. Fit Travel reserves the right to refuse the presence of the user on the chosen stay if the full price of the stay is not paid before the date of departure and will retain the sums paid as cancellation penalties. 

 

2 - PAYMENT TERMS

When registering for one of our stays, it is desired that you deposit a deposit of the amount that will be indicated to you to validate your registration, otherwise it will not be validated. The installments are different, it is calculated according to the total amount of the stay. This amount is listed on each “Practical Information” page of the stays chosen, on our website. It is possible to pay this deposit in 2 instalments to validate your registration, if the stay is not full.

 

Important: 

You can pay the total amount of the stays in several instalments. To compensate for the organization of our  events, we ask:

  • 3 months  before the beginning of the stay: 65% of the sum 

  • 2 months before the start of the stay: 100% of the amount

  • 1 month before the beginning of the stay the total amount must be paid.

If these terms of payment are not respected, we will consider that you cancel your registration. Cancellation penalty fees will be deducted from the total amount of the stay.

 

To date, we accept payment by transfer to the account of Fit Travel, ANYTIME bank, RIB which will be sent to you when you register. And also, by credit card on the website, of the total amount of the stays.
 
3 - MODIFICATION 
 
A/ By you - Before departure 
Modification request: You can request a modification relating to the sports programs (excluding transport) no later than thirty (3 months) before the date of departure, by registered letter to Fit Travel:

Any change request sent less than 3 months and one day before the departure date is considered a cancellation and results in the application of the cancellation fees provided for in Chapter 3 - Cancellation. The renunciation of one of the services included in the stay cannot be the subject of any refund. Any change in the name of a participant or affecting transport is considered a cancellation and results in the application of the cancellation fees provided.

Request for modification of the sports activity during the stays: The sports speakers of the stay (sports coaches, dance teachers, yoga teacher) will decide whether or not to change the course program. They will be the only people authorized and recognized by Fit Travel to change any sporting activity during the stay.

 
B/ Due to Fit travel - Before departure 
Fit Travel may be forced to modify an element of the program planned for the stay due to circumstances that are not attributable to it, reasons inspired by the general interest, or the safety of the participants. Fit Travel will inform participants of these changes, which may include a proposal for substitute elements. If you do not accept the proposed substitute elements, you remain free to request the cancellation of your registration with the reimbursement of the sums already paid.
 
C/ Due to fit travel - After departure 
During the stay, the program may undergo modifications or adjustments, depending on the security requirements or the climatic conditions of the moment. In this case, only those responsible for the Fit Travel framework are authorized to make the necessary decision(s). These changes will not give rise to any refund.
 

4 - CANCELLATION

In all cases, Fit Travel will retain penalty fees calculated on the total price of the stay and varying according to the date of cancellation, according to the conditions listed in the table above. 

Period before the start of the program. Penalties calculated on the net price of the file excluding insurance. 

  • at more than 4 months (91d) = 50%

  • 60 days = no refund

 

For trips abroad such as Miami, New York, Marrakech, Montreal… Penalties calculated on the net price of the file excluding insurance. 

  • at more than 6 months (91d) = 20%

  • at 6 to 5 months = 50%

  • 5 to 3 months = no refund

If you have taken out an insurance pack, the amount cannot be refunded to you.


B/ Due to Fit Travel
Fit Travel may exceptionally be forced to cancel your sports program if: 

  • the minimum number of participants is not reached and in this case, Fit Travel will inform you no later than 20 days before departure,

  • the security conditions require it,

  • in the event of unforeseeable events. Fit Travel will offer you, as far as possible, an equivalent stay at a comparable cost that you are free to accept. You will be informed of the cancellation and the proposal for a new stay by Fit Travel as soon as possible. Any additional cost will be your responsibility. In case of refusal of this new stay, Fit Travel will refund the sums already paid. Apart from this refund, this cancellation does not give rise to any compensation for any reason whatsoever.

 
5 - PRICE 
 
The price of our stays includes sports activities, return transport airport/villa and villa/excursions, accommodation, catering and entertainment as well as civil liability insurance included. The prices of our stays have been calculated as accurately as possible according to the economic conditions known at the time of printing our documentation. They are applicable from publication and until the day of publication of the following edition. They have no contractual value and are confirmed to you when you register. They are subject to possible modifications which apply to all persons already registered or wishing to register. Promotions and reductions are neither cumulative nor retroactive.
The prices displayed include the price of the stay and not the association membership fees.
Regarding the membership fees to the Fit Travel association of 20 euros in addition to the price, are valid for one year. During this period you can benefit from all the activities offered by Fit Travel without paying the membership fee. Beyond that, you will have to pay the membership again.

Warning: 
a/ A significant modification of one of the data below will be reflected in our prices: 

  • cost of transport linked in particular to the cost of fuel; 

  • various fees and taxes for ports and airports (landing, embarkation and disembarkation taxes, security taxes and airport taxes); 

  • exchange rate applied to transport or stay; 

  • change in the dollar exchange rate. The prices of our stays have been calculated on the basis of 1 USD = 1.12 € (as of 31/12/19)

b/ certain traveling destinations include the price of the visits and excursions planned in the stays.


6 - DOCUMENTS (Passport, Visas, Vaccination, etc.) 
 
For each destination, a list of the necessary documents is provided for information purposes only. Fit Travel cannot be held liable in this regard. It is up to each participant to inquire with the organizations concerned and to check the conformity of the documents essential to the chosen stay (in particular for people who are not nationals of the European Union). The procedures and costs for obtaining these documents are your responsibility. In addition, in the event of non-compliance, the resulting consequences (refoulement at the border for lack of a visa or other mandatory document) as well as all costs incurred will remain the responsibility of the participant.
 

7 - TRANSPORTATION
 
Fit travel does not offer, to date, any stay including transport from your city to the place of stay.
Fit Travel currently only covers transport from the airport of the country of stay to the place of accommodation and also during outings listed on the holiday schedule.
Transport will be done in a mini van of 9 (or less) or 14 seats, it all depends on the registrations validated for the stay. Each Fit Travel vehicle will have taken out vehicle insurance at the rental location. 
Fit Travel has no obligation to support users unless this outing is included in the schedule and validated by Fit Travel. The participants of the stay will be the only ones authorized to drive the vehicles if there is not already a driver. And they will also be the only ones authorized to decide whether or not to take charge of users when going out outside the planned outings on the holiday schedule.

 
Warning: 
Fit Travel may have to modify the conditions of carriage for reasons beyond its control. No modification of the conditions of carriage may result in any compensation from Fit Travel for any reason whatsoever, even in the event that these new conditions lead to a modification 
the planned sports program and/or the prize. Any costs of any kind will remain your responsibility. fit travel cannot see its liability substituted for that of the carriers. If you are traveling on your own, late arrival or premature departure cannot give rise to any refund or credit from Fit travel. On the other hand, the responsibility of Fit travel does  may be sought in the event of theft or damage to your personal effects occurring during transport. 
You are advised not to leave valuables, cash, jewellery, cameras, keys or identity papers in your luggage entrusted to carriers. In addition, Fit Travel cannot be held liable in the event of theft or damage to your personal effects occurring during an itinerant sports program taking place outdoors. In the event of theft or loss of your air ticket, Fit Travel will not make any refunds. The purchase of a new ticket will remain your responsibility.

 

8 - OPERATING AND CAUTION RULES 
 
Extreme caution is recommended during the sports program to avoid any incident that could disrupt the normal course of the sports program, not only for yourself but also for the whole group. Each participant must comply with the rules specific to life on a stay. Fit Travel reserves the right to exclude at any time a person whose behavior can be considered to endanger the safety or well-being of other participants. No compensation will be due in this regard. Fit Travel reminds that the introduction of alcohol is prohibited in a stay, if and only if it has been validated by the stakeholders of the stay. A deposit guaranteeing the proper use of the sports equipment made available to you may be requested upon your arrival. This deposit does not cover any additional costs for repairing or replacing the equipment. The amount of this deposit may vary depending on the sports program chosen and/or the sports equipment.
 
Concerning children: The activities offered inside or outside the center remain the responsibility of the parents who can in no way turn against the head of the Fit travel Association. We remind you that the swimming pool is private and not supervised in accordance with the legislation. The registration form includes a disclaimer concerning the swimming pool and the sports structures, including the activities. 


9 - TECHNICAL AND PRACTICAL LEVELS 
 
Sports programs are classified according to intensity criteria. Each participant must comply with the usual rules of caution specific to the practice of physical activity. We strongly invite you to ask the sports speakers present to be informed of the level of the course offered and if it is suitable for you and also to read the documents that may be mandatory for certain activities (medical certificate, patent, license, insurance, etc.). ).
 

10 - EQUIPMENT 
 
The materials provided vary from one sports program to another. For some sports programs only collective or “heavy” equipment is provided (mats, steps, swimming pool sports accessories, light weights, etc.) you must therefore check in the practical information received when you register what type of individual equipment to bring ( shoes, backpack, etc.).
 

Important
Any sports equipment belonging to you remains your responsibility in the event of theft or damage during Fit Travel stays. The responsibility of Fit Travel cannot be sought in this respect. In addition, Fit Travel cannot be held liable in the event of theft or damage to your personal effects occurring during an itinerant sports program or in the places of accommodation. A deposit guaranteeing the proper use of the premises and the sports equipment made available to you may be requested upon your arrival. The amount of this deposit may vary depending on the sports program chosen and/or the sports equipment. The equipment entrusted by Fit Travel is under your responsibility. In case of deterioration of this one, you will be liable for the amount of the repair or replacement before your departure of the stays.
 

11 - FIT TRAVEL INSURANCE
 
Fit travel has taken out civil liability insurance on behalf of its users with the company MAIF assurance RAQVAM Associations et Collectivités. The guarantees for cancellation, interruption, bodily accidents and death, not being included in the cost of the stay, Fit Travel strongly advises you to take out the Multi-risk contract, with our MAIF partner. If you wish to subscribe to the offer, you are invited to check that you are not already the beneficiary of a guarantee covering one of the claims covered by the new contract. If this is the case, you have the right to waive this contract for a period of 14 (calendar) days from its conclusion, without costs or penalties, if all the following conditions are met: 

  • you have taken out this contract for non-professional purposes;

  • this contract comes in addition to the purchase of a good or service sold by a supplier; 

  • you provide proof that you are already covered for one of the claims covered by this new contract;

  • the contract you wish to waive has not been fully performed; l you have not declared any loss covered by this contract. 

In this situation, you can exercise your right to waive this contract by letter or any other durable medium addressed to the insurer of the new contract, accompanied by a document justifying that you already benefit from a guarantee for one of the claims. guaranteed by the new contract. The insurer is required to reimburse you for the premium paid, within 30 days of your waiver. If you have taken out additional guarantees (cancellation – program interruption, assistance – repatriation, etc.) and you wish to benefit from them, it is up to you to take the steps with your insurer.
 

12 - COMPLAINT

Any complaint after departure must be sent within the imperative period of fifteen days after the date of return. After this time, no mail will be considered. You are also required to report any non-compliance observed on site as soon as possible in view of the circumstances of the case. 
 

13 - PROTECTION OF PERSONAL DATA 
 
In accordance with the European legislation in force and in particular within the framework of the general regulation of data protection (EU Regulation 2016/679 of April 26, 2016), Fit Travel as data controller, collects personal data. The information collected about you is processed by Fit Travel. For transfers to countries that do not offer an adequate level of protection, they will be made by means of appropriate guarantees (such as the standard contractual clauses of the European Commission). The information requested from you is necessary for your registration to be processed by our services. Your answers are mandatory, failure to answer makes your registration impossible. The purpose of the processing is also statistical processing, prospecting and the implementation of marketing operations as well as in the context of respecting the legitimate interests of Fit Travel, to which you consent by accepting the general conditions of registration. For safety reasons. The data are kept for the time necessary for the purposes of their 
processing and then archived in accordance with the legal provisions in force. You have a right of access, rectification, portability, erasure of these and / or limitation of processing. Regarding the use of your image for possible films or other, a document is sent to you at the same time as your registration to obtain your agreement. If you do not wish to broadcast your image, it is imperative that the persons in charge of the place of stay respect your wish. 

 

14 - ADDITIONAL INFORMATION


The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the Tourism Code. You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed in the Tourism Code.
Fit Travel will be fully responsible for the proper execution of the package as a whole. For more information on essential rights under Directive (EU) 2015/2302

Travelers will receive all essential information about the package before concluding the package travel contract. 
The organizer and the retailer are responsible for the proper performance of all travel services included in the contract. 
Travelers are provided with an emergency phone number or contact details to reach the organizer or retailer. 


Travelers may transfer their package to another person, subject to reasonable notice and possibly subject to the payment of additional fees. 

In accordance with article R.211-7 of the Tourism Code, you have the option of assigning your contract to a transferee who meets the same conditions as you to make the trip, as long as this contract has no effect. You are required to inform Fit Travel of your decision by any means allowing you to obtain an acknowledgment of receipt and at the latest 1 month before the start of the trip. In the event of assignment of contract, the assignor and/or the assignee are required to pay the costs incurred by the assignment, which will be communicated to you by the organizer.


The price of the package can only be increased if specific costs increase (for example, fuel prices) and if this possibility is explicitly provided for in the contract, and in any case cannot be changed less than twenty days before the start. of the package. If the price increase exceeds 8% of the price of the package, the traveler can terminate the contract. 
If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction in the event of a decrease in the corresponding costs. 
If, after the start of the package, important elements of it cannot be provided as planned, other appropriate services must be offered to travelers, at no additional cost.
